The scheme was set up to enable Dutch employers to attract internationally specialized staff without requiring a separate labor market test for each highly skilled migrant. An important component of the scheme is the system of <strong>recognized sponsorship<\/strong>. The employer also has important responsibilities throughout the employment relationship<strong>.<\/strong><\/p>\n<h2>Conditions for highly skilled migrant status<\/h2>\n<p>The highly skilled migrant scheme has strict conditions for both the employer and the employee. These conditions ensure that only qualified professionals can make use of the scheme.<\/p>\n<h3>Conditions for the employer<\/h3>\n<p>Your employer must be a <strong>recognized sponsor<\/strong> with the IND. This means that the company is registered in the trade register of the Chamber of Commerce and meets strict requirements:<\/p>\n<ul>\n<li>No arrears in social security contributions and payroll taxes<\/li>\n<li>No fiscal penalty surcharges<\/li>\n<li>Reliable directors (possible verification via a certificate of conduct)<\/li>\n<li>Not declared bankrupt<\/li>\n<li>Sufficient continuity and solvency<\/li>\n<\/ul>\n<p>For companies that have been in existence for less than 1.5 years, additional requirements apply. For certain categories, such as certain recently graduated employees, a reduced salary standard applies.<br \/>\nThe salary must also be in line with market rates and must actually be paid. Because salary standards are regularly adjusted, it is important to always check the current amounts before an employment contract is drawn up or an application is submitted.<\/p>\n<p><strong>Employment contract<\/strong><br \/>\nThere must be a valid employment relationship between the employer and the employee. The terms of employment must comply with Dutch laws and regulations. The agreed salary must also meet the conditions of the highly skilled migrant scheme.<\/p>\n<h2>Procedure and required documents for highly skilled migrants<\/h2>\n<p>The highly skilled migrant procedure takes place in several steps, in which both the employer and the employee play a role. The new employer must qualify for the highly skilled migrant scheme and must generally also be a recognized sponsor. In addition, the other conditions, including the applicable salary standard, must be met.<br \/>\nA change of employer must also be processed correctly with the IND. It is therefore important to assess a job change not only from an employment law perspective, but also from a residence law perspective.<\/p>\n<p><strong>Is the expat scheme (formerly the 30% ruling) automatically part of the highly skilled migrant scheme?<\/strong><br \/>\nA common misconception is that every highly skilled migrant automatically has the right to the expat scheme.<br \/>\nThat is not the case. The expat scheme is a separate tax scheme with its own conditions.
